This webpage sets the Terms and Conditions governing the use of this website and the purchase of items through this website. Please read through these Terms and our Privacy Policy (together with the “Data Protection Policies”) prior to using this website.

By using this website or placing an order through it, you are consenting to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree to all of our Terms & Conditions and our Privacy Policy, do not use this website. These Terms & Conditions and our Privacy Policy may be amended. It is your responsibility to regularly read through them, at the time that you use this website or at the time of the formation of the Contract.

Our Details

Sales of Dazzling & Hypnotic items through this website are carried out by Dazzling & Hypnotic, a company registered in the Netherlands under registration number 80550371. Our registered address is Nieuwe Molstraat 17 C, 2512 BH, The Hague, Netherlands. Our VAT number will appear on your invoice.

Dazzling & Hypnotic will be referred hereinafter as “us”/”we”/”our”/”Dazzling & Hypnotic”.

Your Details and Your Visits to this Website

The information or personal details that you provide us with shall be processed according to the Privacy Policy. By using this website, you are consenting to the processing of such information and details and you represent that the whole information or details you have provided us with are true and accurate.

Section 1: Applicability of the Terms & Conditions

The Terms and Conditions apply to all offers and deliveries from, and agreements with, Dazzling & Hypnotic, unless otherwise explicitly agreed on in writing.

If you declare other provisions or terms applicable in his order will only be binding upon Dazzling & Hypnotic if Dazzling & Hypnotic has explicitly accepted them in writing.

Section 2: How the Contract is Formed?

Users over 18 years old can purchase. By placing an order through this website, you warrant that you are at least 18 years old and are legally capable of entering into binding contracts.

The information set out in the Terms & Conditions and the detail contained on this website do not constitute an offer for sale, but rather an invitation to treat. No contract in respect of any items will exist between us and you until your order has been accepted by us, whether or not funds have been deducted from your account. If we do not accept your offer and funds have already been deducted, these will be fully refunded.

To place an order, you must follow the online shopping process and submit the order. After this, you will receive an email from us confirming receipt of your order (the “Order Confirmation”). Please note that this does not mean that your order has been accepted. Your order constitutes your offer to us to buy one or more items from us. All orders are subject to acceptance by us, and we will confirm this acceptance to you by sending you an email that confirms that the item is being sent (the “Shipping Confirmation”). The contract for the purchase of an item between us (the “Contract”) will be formed when we send you the Shipping Confirmation. The Contract will relate only to those items whose dispatch we have confirmed in the Shipping Confirmation.

Section 3: Orders & Refusal of Order

Please note that all orders are subject to acceptance and availability, and items in your shopping basket are not reserved and may be purchased by other customers.

Once you have made your choice and your order has been placed, you will receive an email with your order details. This email is NOT an acceptance of your order, just a confirmation that we have received it.

You have the right to dissolve the contractual agreement. But unless you cancel your order, acceptance of your order and completion of the contract between you and Dazzling & Hypnotic will be completed when we email you to confirm the goods have been dispatched. The sale contract is therefore concluded in The Hague, Netherlands and the language of the contract is English.

Note that Dazzling & Hypnotic is authorized to engage any third parties in the fulfilment of its commercial obligations. Neither our third-party payment processor nor our nominated courier has the authority to accept an order on behalf of Dazzling & Hypnotic.

Dazzling & Hypnotic reserves the right not to accept your order or cancel the order by notifying the client and even delivering a product that is comparable in nature and quality to the ordered product. This might occur in the event, for example, that we are unable to obtain a payment authorization, there are shipping restrictions on a particular item, that the item ordered is out of stock or does not satisfy our quality standards and is withdrawn, or that you do not meet the requirements set in our Terms & Conditions.

We may also refuse to process and therefore accept a transaction for any reason or refuse service to anyone at any time at our sole discretion. We reserve the right to withdraw any items from this website at any time and/or remove or edit any materials or content on this website. We will not be liable to you or any third party by reason of our withdrawing any item from our store whether or not that item has been sold, removing, screening or editing any materials or content on our website, refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

We try to ensure that all the details on our website are accurate, we may from time to time discover an error in the pricing of our items. If we discover an error in the pricing of a product in your order, we will let you know as soon as possible. We shall be under no obligation to accept or fulfil an order for a product that was advertised at an incorrect price and reserve the right to cancel such an order that has been accepted or is in transit. If you order a product that is priced incorrectly for any reason, we will email you to inform you that we have not accepted your order and/or that the relevant part of your order has been cancelled. If you have already paid for the goods, we will refund the full amount. In the event that items have been dispatched, we will process your refund once the products have been returned to us.

Dazzling & Hypnotic mostly offers products for sale that are in stock and available for dispatch. However, occasionally, we may use drop shipping services to deliver certain items, which means that delivery services will depend on a third-party. Regarding our handmade jewellery and customized items, you may from time to time be given the possibility of making an advance payment or pre-order for certain items. This will ensure that you receive this item on priority once the item has been confectioned.

Therefore, items received into stock may be pre-allocated to satisfy pre-orders. Please be also aware that we may not be unable to deliver selected pre-ordered items, or the delivery period of pre-ordered items may be longer due to production problems or quality check issues identified when we receive an order into stock. In these circumstances, we will notify you by email and keep you updated during the waiting process. Alternatively, you can always choose, with prior notification, not to continue with your pre-order. If so, we will refund the advance payment to your credit/debit card within thirty (30) days of your decision or being communicated that the item has become unavailable.

If you have signed up with your email address for notification of the arrival of a specific item on our store, we will attempt to notify you by email within 48 hours of the product becoming available on Dazzling & Hypnotic. Please be aware that on occasion certain products that are in high demand might sell out during this period.

Dazzling & Hypnotic will store a record of your transactions for at least seven years, for tax purposes.

Section 4: Availability of Items

All orders for items are subject to availability and in this regard, in the event of supply difficulties or because items are no longer in stock, we reserve the right to give you information about substitute items of an equal or higher quality and value which you can order. If you do not wish to order the substitute items, we will reimburse what you may have paid.

Section 5: Pricing Information

The prices shown on our website are in Euros. All purchases done through this website are subject to the statutory Value Added Tax (VAT), but exclude delivery costs, which will be communicated to you and added to the total amount due.

All prices and offers remain valid as advertised from time to time. However, sometimes prices are subject to change in response to markdowns and other commercial factors. The price applicable to your order will be the current price at the time your order is accepted (except in cases of a system error).

Even though we tried to have the most accurate information, Dazzling & Hypnotic cannot guarantee that all information on the website is displayed correctly and/or is complete at all times. All prices and other information displayed on the website and on other materials originating from Dazzling & Hypnotic may include typographical and/or programming errors. Dazzling & Hypnotic is not liable for such typographical and/or programming errors and reserves the right to correct such errors at all times.

If we discover an error in the price of items you have ordered, we will inform you as soon as possible and give you the option of reconfirming the order at the correct price or cancelling it. If we are unable to contact you, the order will be treated as cancelled and if you have already paid for the items you will receive a full refund and require the return of any products provided. We are under no obligation to provide the items to you at the incorrect price (even after we have sent you a Shipping Confirmation).

Section 6: Payment Information

You shall pay the amounts due to Dazzling & Hypnotic in accordance with the ordering process and through the payment method selected on the website. We are free to offer any payment method of our choice and may change these payment methods at any time.

You should be aware that if you are paying in EU currencies other than euros, you may still be charged a currency conversion fee by your card provider when you use your card in another EU country.

Any refunds will be provided by the method used by you for payment unless agreed otherwise.

We accept payments methods and any other methods which may be clearly advertised on the website. You can also choose to pay with PayPal. When selecting this option at checkout, you will be directed to the PayPal site to ‘Log In’ and review the amount shown before clicking ‘Pay Now’. Once this transaction is complete, you will be sent back to Dazzling & Hypnotic’s website. Payment will be debited and cleared from your account upon dispatch of your order by Dazzling & Hypnotic.  All credit/debit cardholders are subject to validation checks and authorization by the card issuer. If the issuer bank of your card refuses to authorize the payment to us, we will not be liable for any delay or non-delivery.

We take care that our website is secure, Dazzling & Hypnotic uses Secure Socket Layer (SSL) technology. All credit/debit card transactions on this site are processed using a secure online payment gateway that encrypts your card details in a secure host environment. If you are a registered Dazzling & Hypnotic user, we will securely store your payment details on our systems. This information will only be used to process card transactions that you have started.

In addition, we do everything that is in our power to keep your personal information and payment secure, but in the absence of negligence on our part, we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from the website.

Section 7: Buying Items as Guest

The functionality of buying items as a guest is also available on this website. For this type of purchase, we will only request from you the essential data that is required to process your order. Upon completion of the purchase process, you might be offered the possibility of registering as a user or continuing as a non-registered user.

Section 8: Registration & Account

To use some of our services you might need to register for an account. When you register you are required to provide information about yourself.

By creating an account with us, you will be able to:

  • Review past purchases
  • Save your address and card details so you can shop even quicker next time
  • Manage your account details, address book, and email preferences

To create an account, simply click on SIGN IN and then fill in your details. The account password you create should be unique and kept secure, and you must notify Dazzling & Hypnotic immediately of any breach of security or unauthorized use of your account.

Forgotten password

If you have forgotten your password,  follow the FORGOTTEN PASSWORD instructions on the SIGN IN page. For security reasons, we will not be sending your password via email.

Section 9: Risk & Title

As long as Dazzling & Hypnotic has not received full payment for the products, we will retain the ownership of the products. You will own the product after Dazzling & Hypnotic has received payment in full.

The items will be at your risk from the time of delivery.

Section 10: Delivery

You will own the goods on and from the later of the point in time when we receive the payment in full.

Delivery times appearing on the website are an estimation and need to be considered only from the date of the shipment. Please note however that we do not deliver on Saturdays or Sundays. In any event, we will deliver the goods to you within 90 days of the day on which we accept your order.

Although, we provide estimated information describing the manner of delivery of the products and an estimation of the term in which the products will be delivered to you. If Dazzling & Hypnotic is unable to deliver the products within thirty (90) days after the confirmation of acceptance of the order, it will notify the client accordingly.  In such an event, you have the right to either agree to a new delivery date or to dissolve the Contract without incurring any costs, and you will receive a refund for any products paid for but not received. Dazzling & Hypnotic is not liable for any delay in the delivery process or delays caused by destination customs clearance processes.

If delivery is delayed by an event out of our control, we will contact you as soon as possible to let you know, and we will take steps to minimize the effect of the delay. Provided we do this, we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the Contract and receive a refund for any items you have paid for but not received.

Dazzling & Hypnotic advises the client to inspect the products upon receipt and to report any defects within five (5) working days after delivery, in writing or by email, and in any case within a reasonable period of time after discovering the defect.

Section 11: Transfer of Ownership

As soon as the product has been delivered to the delivery address submitted by you, the risk of the product fully transfers to you, without prejudice to any rights consumers may have.

Section 12: Retrurns Policy

You may return your order for any reason up to fourteen (14) days starting from the day after the order has been delivered to you to do so.

Before returning your product(s), notify us of your decision by emailing us at hello@dazzlinghypnotic.com within the fourteen (14) days reflection period after the day of delivery to inform us which products you would like to return. In this email, the customer must include the following information: order number, product(s) you would like to return, name, phone number, email address, and delivery address. We will gladly issue a refund if the return conditions have been met. 

You must send the goods back within 14 days of informing Dazzling & Hypnotic. Please address your return package to:

Products must be returned unused, unwashed, unaltered, undamaged, and in their original packaging including all documents and any accompanying items. For this reason, you should leave the packaging intact as much as possible. And when you return the product, you must pack it neatly. In case products cannot be returned in their original packaging, please make sure you choose an appropriate shipping box for your return to prevent the content(s) from being damaged while in transit.

Regarding the exemptions, you are not allowed to return items classes as “Excluded Items”. These include:

  • Items that have been made to your specifications or personalized (custom made);
  • Digital products provided through direct download due to redistribution issues;
  • Items that are not suitable for return for health protection and hygiene reasons (eg. swimwear with no hygiene label, earrings, hair accessories, and socks). 

Please arrange a return shipment using a carrier of your choice. We apologize you must bear the return shipping costs, which are non-refundable. We are not responsible for any returns lost or damaged in transit, which is why we recommend using an insured delivery method with tracking information and always asking for proof that the package has been delivered to a postal company or the courier service.

After we have received and accepted the returned products, we will process your return request as soon as possible. If all conditions are met, we will gladly refund the total purchase amount including delivery costs (shipping costs are only refundable to customers residing in Europe for clients residing outside Europe shipping costs are non-refundable), to the original form of payment within fourteen (14) days of receiving your return. Please note that if you have chosen a shipping method that was more expensive than the “standard shipping method”, Dazzling & Hypnotic will only reimburse the price of the “standard shipping method”.

Please note that if you are returning part of your order. Then Dazzling & Hypnotic will not refund the delivery costs.

In the case that we have sent goods to you and you have cancelled your order, we may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent the goods back. You shall return cancelled orders to the address above.

Defective products

If the item(s) that you have received is defective, please notify us by email, and return the item(s) to the above-stated address. Please provide proof of purchase. We will examine the item(s) and if we deem it to be defective, we will provide a full refund including delivery charges, and the refund will be paid using the same means of payment that you originally used to pay for your purchase.

Section 13: Right to Withdraw

You have the right to withdraw from your order within 14 days, without giving any reason, although please note you have no right to withdraw items that are classed as ‘Excluded Items’. See return policy. The withdrawal period is counted from the day after the delivery of the last item(s) in your order. The easiest way to exercise your right of withdrawal is to contact us by sending an e-mail to hello@dazzlinghypnotic.com and returning the goods to us using the method described in the return policy.

We will refund all payments received from you, including the costs of delivery to the original delivery address (although we will not refund any supplementary delivery costs if you chose an enhanced type of delivery rather than our least expensive type of standard delivery), without undue delay and in any event no later than 14 days from the day on which we are informed about your decision to withdraw. We will use the same means of payment that you used to pay for your order.

In the events that the product/s have been already shipped to you. We may withhold the refund until we have received the items back, or you have supplied evidence of having sent back the items, whichever is the earlier. You must send back the items or hand them over to us without undue delay, and in any event no later than 14 days from the day on which we are informed about your decision to withdraw.

Section 14: Complaints Handling Procedure

If you have a complaint about a product or regarding any other aspects of the website or service, you can submit a complaint by email at hello@dazzlinghypnotic.com. We will try to respond to the complaint as soon as possible.

The more details or information you provide us the faster and better we can solve the issue.

Section 15: Intellectual Property

You acknowledge and agree that all copyright, such as text, graphics, images, icons, trademarks, and all other intellectual property rights in all material or content supplied as part of this website shall remain at all times vested in us or our licensors. Access to this information does not entitle you to any rights. These materials may not be copied, distributed, or used for any other purpose without the express written consent of Dazzling & Hypnotic, except as otherwise allowed by law.

Section 16: Third Parties

We may have links from our website to other third-party websites and materials; such links are provided exclusively for information purposes and we do not have any control whatsoever over the contents of such websites or materials. Accordingly, we accept no liability whatsoever for any loss or damage which may arise from the use of such links.

Section 17: Liability

For consumers. To the extent allowed under applicable (local) mandatory law, the total liability of Dazzling & Hypnotic in respect of the client due to an attributable failure to perform the Contract is limited to a compensation which does not exceed the price stipulated for that particular Contract (including VAT and shipping costs).

Dazzling & Hypnotic does not exclude or limit in any way its liability to you where it would be unlawful to do so.

To the extent permitted by applicable law, and without prejudice to any rights consumers may have, Dazzling & Hypnotic will only be liable to the Client on account of an attributable failure in the performance of the Contract if the Client issues a written notice of default to Dazzling & Hypnotic without delay, stipulating a reasonable period of time in which Dazzling & Hypnotic has the possibility to remedy the default, and Dazzling & Hypnotic fails to cure the default within such period (unless the default cannot be remedied). The notice of default must contain a description of the default in as much detail as possible, in order to enable Dazzling & Hypnotic to provide an adequate response and/or take adequate action.

Any event giving rise to compensation is always subject to the condition that the Client reports the damage or loss in writing to Dazzling & Hypnotic as soon as possible, but no later than within thirty (30) days after the damage or loss has arisen.

Dazzling & Hypnotic are not liable for business losses. We only supply the items for private use. If you use the items for any commercial, business, or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

Dazzling & Hypnotic has a legal duty to supply items to you that are in conformity with the Contract, however, without affecting that duty and to the fullest extent permitted by law, all item descriptions, information, and materials posted on this website are provided “as is” and without warranties express, implied or otherwise howsoever arising. Where you are contracting as a consumer, in line with our obligations at law, we will be responsible for delivering items to you that: (i) comply with the description given by us and possess the qualities that we have presented in this website, (ii) are fit for the purposes for which items of their kind are normally used and (iii) show the quality and performance which are normal in items of the same type and can which can reasonably be expected.

We warrant to you that any item purchased from us through this website is of satisfactory quality and reasonably fit for all of the purposes for which items of the kind are commonly supplied. To the fullest extent permissible pursuant to law, but without excluding anything that may not lawfully be excluded in the case of consumers, we disclaim all other warranties of any kind, whether express or implied, in relation to the items available on this website. Items (including handicraft items) sold by us will often contain the natural characteristics of the materials used in the manufacture of the completed item. Natural characteristics such as grain, texture, knots, and colour variation should not be classed as faults or defects. Inconsistencies in these natural characteristics should be expected and appreciated. We select only items of the highest quality, but natural characteristics are inevitable and should be accepted as part of the individual appearance of the item. Nothing in this Clause will affect your statutory rights as a consumer, or your Contract cancellation rights.

Dazzling & Hypnotic is not liable for any failure or delay in the performance of its obligations under the Contract or any damage or loss you have incurred caused by force majeure, meaning any event beyond the reasonable control of Dazzling & Hypnotic or any third parties engaged by Dazzling & Hypnotic to fulfil its obligations under the Contract to the extent permitted under applicable law.

Due to the open nature of this website and the potential for errors in the storage and transmission of digital information, Dazzling & Hypnotic do not warrant the accuracy and security of information transmitted to or obtained from this website unless otherwise expressly set out on this website.

Section 18: Hacking & Other Cyber-Crimes

You may not misuse this website by knowingly introducing viruses or other material which is malicious or technologically harmful. You will not attempt to have any unauthorized access to this website, to the server which hosts this site or to any other server, computer or database related to our website. You undertake not to attack this website via a denial of service attack or a distributed denial-of-service attack. By breaching this provision, you may commit a criminal offense under the applicable regulations. We will report any such breach to the relevant law enforcement authority, and we will co-operate with the appropriate authority to disclose the identity of the hacker. Likewise, in the event of such a breach, your right to use this website will cease immediately. We will use reasonable care and skill to ensure that this website is safe, secure, and free from bugs, viruses, and other defects. Except to the extent it results from our failure to do so, we accept no liability for any loss or damage resulting from any denial of service attack, virus or any other software or material which is malicious or technologically harmful to your computer, equipment, data or material resulting from the use of this website or from the downloading of the contents thereof or of such contents to which this website redirects.

Dazzling & Hypnotic cannot promise that Dazzling & Hypnotic’s content is accurate or free of error. Dazzling & Hypnotic does not promise that the content of its website or the server that makes it available are free of viruses or other harmful components. We recommend all users of the Internet that they must have an up to date antivirus software installed.

Section 19: Events Outside our Control

We will not be liable or responsible for any failure to perform or delay in performance of, any of our obligations under the Contract that is caused by events outside our reasonable control. This includes the following:

  • High demands seasons.
  • Strikes, lockouts, or other industrial action.
  • Natural disaster.
  • Epidemics and pandemics.
  • Impossibility of the use means of public or private transport.
  • Any shipping, postal, or other relevant transport strikes, failure, or accidents.

Our performance under any Contract is deemed to be suspended for the period that any event outside our control continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the event outside our control to a close or to find a solution by which our obligations under the Contract may be performed despite the event outside our control.

Section 20: Waiver

If we fail, at any time during the term of the Contract, to insist upon strict performance of any of your obligations under the Contract or any of these Terms, or if we fail to exercise any of the rights or remedies to which we are entitled under the Contract, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations. A waiver by us of any default shall not constitute a waiver of any subsequent default arising from the Contract or the Terms. No waiver by us of any of these Terms shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing.

Section 21: Law & Jurisdiction

The General Terms and Conditions and the Contract are exclusively construed in accordance with and shall be exclusively governed by Dutch law.

Except in case of a dispute with a consumer, any dispute arising out or in connection with the General Terms and Conditions and the Contract, including disputes concerning the existence and validity thereof will, if no amicable settlement can be reached, be exclusively submitted to the competent court of Amsterdam.

If you are a consumer and resides within the European Union, or in Norway, Iceland or Liechtenstein, you may also be able to refer a dispute to the European Online Dispute Resolution (“ODR”) platform at http://ec.europa.eu/consumers/odr. The ODR platform is a web-based platform that is designed to help consumers who have bought products or services online. It provides access to independent alternative dispute resolution services which are usually free for consumers to use.

Dazzling & Hypnotic has the discretion as to whether it will agree to a complaint being resolved through the ODR platform.

Dazzling & Hypnotic has the right to make changes to these General Terms and Conditions. We will notify clients if such changes are significant and/or have an adverse effect on client’s rights and obligations under the agreement.
